These General Conditions relate to the purchase of products and services, carried out remotely via computer network, on the website WWW.FULLGUI.IT owned by TUCONME SRL based in Formello (RM) at Via degli Olmetti 5/A. p.iva15144221002

1. DEFINITIONS

For the purposes of these Terms and Conditions, and in addition to the other definitions provided herein, the following terms shall have the meanings set forth below:

1.1 “General Conditions”: these are all the conditions of sale, applicable to the contractual relationship between FULL GUI and the Customer
1.2 FULL GUI is the company that intends to carry out the sale through the site present at www.fullgui.it limited to the Italian and EU territory of the products belonging to its assortment
1.3 “Products”: these are all the products and services and/or goods marketed by fullgui.it and forming part of its assortment.
1.4 “Customer”: is the purchaser of the Products, meaning the natural person over 18 years of age or the legal person who makes the purchase also for purposes referable to the commercial or professional activity carried out, if any.
1.5 “Site”: is the set of Web pages related to www.fullgui.it
1.6 “Promotions”: are the sales made by fullgui.co.uk for all or part of the Products and for limited periods of time at a discount from the normal sale price.

2. SCOPE – EFFECTS

2.1 The General Conditions apply to any sale concluded between the Customer and fullgui.it and made through the Site. Sending an order implies acceptance by the Customer of these General Conditions.

2.2 The General Conditions concern only the sale to a Customer, as specified above.

2.3 Any changes or new terms of sale will be effective upon publication on the Site and will apply only to sales completed after publication.

2.4 The contract is concluded, and is binding on both parties, when the purchase order confirmation is sent to the Customer

2.5 fullgui.co.uk reserves the right not to accept incomplete or improperly filled orders.

2.6 fullgui.it assumes no liability for inefficiencies attributable to force majeure of any nature or kind, in the event that it fails to execute the contract within the agreed time. Causes of force majeure include, but are not limited to, measures taken by the Public Authorities, strikes by its own employees or by the carriers that the company uses, as well as any other circumstance that is beyond its control.

3. PRICES.

All prices entered on the website are exclusive of VAT Prices do not include shipping and/or insurance.

Prices may be changed at any time without notice.

In the event of a change in an order, the price of the new products will be the price indicated on the site at the time of the change if the products are different from those covered by the original order, while the price indicated at the time of the order will remain applicable if the change only concerns the quantity of the products already ordered.

4. CUSTOMER REGISTRATION

Before proceeding with the purchase of the Products, the Customer will have to fill out the master data sheet in the registration procedure on the Site, releasing the data necessary for the order processing and shipping of the products (first name, last name, residence, telephone number and tax code). Registration is free and will be required only at the time of the first purchase.

To access the purchase, registration is required, indicating the company name, legal representative, registered office, telephone numbers, VAT number and tax code. Once the registration request has been received on the website www.fullgui.it the company TUCONME SRL will carry out the necessary verifications, in order to guarantee access to the reserved area, exclusively to hairdressers. It is understood that once membership in the category has been ascertained, the hairdressers themselves will be able to view the prices reserved for them. Acceptance of registration will be communicated with an email.

The company TUCONME SRL reserves the right NOT to accept any orders if it has the doubt or confidence that the purchase is made by a company that does not belong to the category of hairdressers despite the fact that TUCONME SRL has previously authorized access to the reserved area. The Customer undertakes to communicate correct, truthful and complete data regarding personal details, personal contact details, other information useful for the execution of the Order.

5. PAYMENTS

Payment for the price of the Products and related shipping costs must be made by the Customer exclusively by credit card.

CREDIT CARD: The credit card payment transaction is carried out on secured circuits. The financial information (card number, expiration date, header, etc.) will be automatically forwarded via encrypted protocol to Stripe without TUCONME SRL based in Formello (RM) at Via degli Olmetti 5/A. p.iva15144221002 or third parties can in any way have access to it.

The administration may request proof of identity to verify the correct credit card header. This information, moreover, will never be reused except to issue any refunds for returns, in the cases provided for in Right of Withdrawal.

6. PRODUCT AVAILABILITY

Our computer system automatically manages availability.

The updating of availability with the realignment of the warehouse occurs every 24h, so there may arise, in some circumstances, problems related to the online display of availability. In case of ordered goods not available, the same will be shipped at a later date at our expense or in case of non-availability of the goods, the customer may request an exchange for other similar goods or a refund of the amounts of the goods not received.

7. ISSUANCE OF ACCOMPANYING INVOICE

For each order will be issued automatically (at the time of payment) an accompanying tax receipt that will travel together with the goods, visible at any time from within your account. The invoice, on the other hand, will be issued exclusively to VAT holders and will be sent via email.

8. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

The contract entered into between TUCONME SRL and the Customer must be considered concluded with the acceptance, of the order by TUCONME SRL. By placing an order in the various ways provided, the Customer declares that he has read all the indications provided to him during the purchase procedure, and fully accepts the general and payment conditions clearly stated on the site. Is excluded any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property, caused by the non-acceptance, even partial, of an order.

9. MODE OF PURCHASE

The Customer may purchase only the products present on the site www.fullgui.it, at the time of placing the order. It is understood that the IMAGE accompanying the descriptive sheet of a product and / or equipment may not be perfectly representative of its characteristics but differ in color, size, accessory products present in the picture. The correct receipt of the order is confirmed by TUCONME SRL with registered office in Formello (RM) at Via degli Olmetti 5/A. p.iva15144221002 by an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will contain an ‘Order Number’, to be used in any further communication with TUCONME SRL.

10. RIGHT OF WITHDRAWAL

10.1 The Customer’s rights are protected by Legislative Decree 206/2005 as amended. The Customer who for any reason is not satisfied with the purchase made, has the right to withdraw from the contract entered into and to return the Products ordered, if already delivered, without penalty and without specifying the reason.

10.2 The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter A.R. TUCONME SRL with registered office in Formello (RM) at Via degli Olmetti 5/A. p.iva15144221002 within the term of fourteen working days from the day of receipt of the Products.

10.3 The Customer may not exercise the right of withdrawal in the case of a) custom-made or personalized goods; b) goods that by their nature cannot be returned or are liable to deteriorate or alter rapidly; c) to the supply of sealed goods that are not suitable for return for hygienic or health protection-related reasons and have been opened after delivery.

10.4 If the withdrawal is made in observance of the above conditions, the amount paid for the Products and delivery charges shall be credited to the purchaser by bank transfer to an account in the purchaser’s name.

10.5 The refund is free of charge and is made as quickly as possible, and in any case within 30 days from the date on which TUCONME SRL learns of the exercise of the right of withdrawal by the Customer.

10.6 Within 10 working days from the exercise of the right of withdrawal, the Customer must ship or deliver the returned Products to the following address: TUCONME SRL based in Formello (RM) at Via degli Olmetti 5/A. p.iva15144221002

10.7 Returned Products must be returned undamaged, unused and in the original packaging.

10.8 The only costs borne by the Customer for the exercise of the right of withdrawal are the direct costs of returning the Products to TUCONME SRL.

10.9 Under no circumstances are cash-on-delivery or freight collect packages.

11. PRODUCT DELIVERY MODE AND SHIPMENT

The shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer; Note: in case of return of goods, we suggest the use of an express courier trusted by the customer in order to be able to take advantage of the shipment tracking service and the additional shipment insurance service in the case of goods of particularly high value. The possibility to withdraw is excluded for all products sealed for hygienic reasons and for those already opened by the consumer, it is not possible instead to exercise the withdrawal only on a (partial) part of the purchased product. The goods must be returned intact, complete with all its parts (including original packaging) and without having suffered any damage even in the packaging. To limit damage to the original packaging, it is recommended, when possible, to place it in a second box, bearing the return authorization code; the affixing of labels or adhesive tapes directly on the original packaging of the goods should be avoided in all cases. If the packaging and/or the original packaging is damaged, TUCONME SRL will not proceed to refund the returned goods. Once received, the goods will be examined and, in the presence of damage or tampering TUCONME SRL will notify the customer of the incident within 5 working days of receipt, and the withdrawal can not be exercised. REFUND: TUCONME SRL will refund the customer the full amount already paid referred exclusively to the value of the products purchased, within 14 days from the date of receipt of the goods. Shipping and/or insurance costs incurred at the time of the order are excluded. PLEASE NOTE: products sent after the above terms, at our premises, lacking the above requirements will not be refunded. Therefore, in case of forfeiture of the right of withdrawal, TUCONME SRL will return to sender the purchased goods, charging the same shipping costs.

13. CONTROVERSIES

13.1 Any dispute relating to the application, execution, interpretation and breach of the contract entered into online by the Customer with fullgui.it, is subject to Italian jurisdiction.

13.2 For any dispute between the parties in this regard the Court of ROME shall have exclusive jurisdiction, as of now derogating the parties from any further different territorial jurisdiction.

14. APPLICABLE LAW AND REFERRAL

14.1 Contracts entered into online by the Client with TUCONME SRL are governed by Italian law.

14.2 For anything not expressly provided for herein, the rules of law applicable to the relationships and cases provided for in the contract entered into online by the Customer with TUCONME SRL shall apply

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Customer declares that he/she has carefully read and expressly accepts and in particular the following clauses of the General Terms and Conditions of Sale of fullgui.it: 6. Availability of Products; 10. Right of withdrawal; 13. Disputes; 14. Applicable Law and Referral.
